These Terms of Use ("Terms") are a legal agreement between you and Escape Apps LLC ("we", "our", "us") governing your use of the Range Reps mobile application ("Range Reps" or the "App"). By downloading, installing, or using the App, you agree to these Terms. If you don't agree, don't use the App.
We grant you a limited, non-exclusive, non-transferable, revocable license to use Range Reps on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, redistribute, or create derivative works from the App.
You retain all rights to the data you create in Range Reps (sessions, templates, swing thoughts, ratings, etc.). Your data is stored locally on your device and, if you enable iCloud sync, in your private iCloud account. See our privacy policy for details.
Range Reps offers an optional "Pro" subscription that unlocks additional features. Subscriptions are sold through Apple's App Store and are subject to the following:
You agree not to use Range Reps in any way that violates applicable law, infringes on anyone's rights, or interferes with the App's intended operation. We reserve the right to suspend or terminate access for any user who violates these Terms.
Range Reps, including its name, logo, design, code, and content, is owned by Escape Apps LLC and is protected by copyright, trademark, and other laws. These Terms don't grant you any rights to our trademarks or branding.
Range Reps is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the App will be uninterrupted, error-free, or compatible with every device.
To the maximum extent permitted by law, Escape Apps LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the App. Our total liability for any direct damages is limited to the amount you paid us for the App in the 12 months preceding the claim (or $50, whichever is greater).
You acknowledge that these Terms are between you and Escape Apps LLC only, not with Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. Apple has no other warranty obligation whatsoever with respect to the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
You can stop using Range Reps at any time by deleting the App. We can terminate or suspend your access to the App at any time if you violate these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
These Terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the App will be resolved in the state or federal courts located in Kentucky.
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
